1. Acceptance of Terms
By accessing or using HelmWatch ("the Service"), operated by HelmWatch LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
HelmWatch provides vessel monitoring, alerting, and safety management tools including sensor data ingestion, alert notifications, AI-powered assistance, float plan management, crew coordination, and voyage tracking. The Service is provided on a per-vessel subscription basis.
3. Account Registration
You must create an account using a supported identity provider (Google or Apple). You are responsible for maintaining the security of your account and for all activities under your account. You must provide accurate, current information.
4. Subscriptions and Payment
Cloud features require an active subscription per vessel. Subscriptions are billed annually via Stripe. A 30-day free trial is provided for each new vessel. You may cancel at any time; access continues until the end of the current billing period. Refunds are handled in accordance with our refund policy.
5. Limitation of Liability
HelmWatch is a monitoring tool and does not replace proper marine safety practices, equipment, or judgment. HelmWatch is not a substitute for a proper watch, safety equipment, coast guard monitoring, or emergency services. We are not liable for any damages resulting from equipment failure, network outages, notification delays, or reliance on the Service for safety-critical decisions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELMWATCH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
6. User Responsibilities
You are responsible for ensuring proper installation, configuration, and maintenance of all sensors and network equipment. You agree not to use the Service for any unlawful purpose or in violation of any applicable regulations.
7. Data and Privacy
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of data as described in the Privacy Policy.
8. Intellectual Property
The Service, including all software, designs, and content, is the property of HelmWatch LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
9. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your vessel data before account termination.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of King County, Washington.
